§1 Applicability to Entrepreneurs and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity (§ 13 BGB - German Civil Code).

§2 Conclusion of a Contract, Storage of the Contract Text

(1) The following regulations regarding the conclusion of the contract apply to orders made via our online shop https://carboncasedealer.com.

(2) In the event of the conclusion of a contract, the contract is made with:

(3) The presentation of goods in our online shop does not constitute a legally binding contract offer from our side, but is only a non-binding invitation for the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

(4) Upon receipt of an order in our online shop, the following regulations apply: The consumer makes a binding contractual offer by successfully completing the order procedure provided in our online shop.

The order process takes place in the following steps:

1. Selection of the desired goods
2. Confirmation by clicking the “Order” button
3. Review of the information in the shopping cart
4. Clicking the “Checkout” button
5. Registration in the online shop after signing up and entering the login details (email address and password)
6. Final review and correction of the entered data
7. Binding submission of the order by clicking the “order with obligation to pay” or “buy” button

Before the binding submission of the order, the consumer can return to the page where customer details are entered and correct any input errors by pressing the “Back” button in their internet browser or cancel the order process by closing the internet browser. We immediately confirm receipt of the order by an automatically generated email (“Order Confirmation”). With this email, we accept your offer.

(5) Storage of the contract text for orders placed via our online shop: We will send you the order details and our General Terms and Conditions via email. You can also view the General Terms and Conditions at any time at https://minidy.de. For security reasons, your order details are no longer accessible via the internet.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The prices listed include the statutory value-added tax and other price components. Additional shipping costs may apply.

(2) The consumer has the following payment options: advance payment, direct debit, PayPal, or credit card (Visa).

(3) If the consumer selects advance payment, they are obliged to pay the purchase price immediately after the conclusion of the contract.

§4 Delivery

(1) Unless otherwise stated in the product description, all items offered by us are ready for shipment immediately. Delivery will be made within a maximum of 20 business days. In the case of advance payment, the delivery period begins the day after the payment order is issued to the transferring bank. For all other payment methods, the period begins the day after the contract is concluded. If the delivery period ends on a Saturday, Sunday, or public holiday at the delivery location, the period will end on the next working day.

(2) The risk of accidental loss or deterioration of the sold goods does not pass to the buyer until the goods are handed over, even in the case of a shipment sale.

(3) Delivery Times
We make every effort to dispatch all orders within the delivery times stated on our website. However, the indicated delivery times are non-binding and may vary due to external factors beyond our control (e.g., logistics issues, natural events, strikes, or pandemics).

(4) Delays Due to High Demand
In exceptional cases, especially during periods of high demand or sales promotions, delivery times may be extended. If your order is delayed, we will notify you promptly via email and provide a new delivery date, if possible.

(5)  Withdrawal from the Purchase Contract in Case of Delay
If we fail to deliver your order within 14 days after the original delivery time has expired, you have the right to withdraw from the contract and receive a full refund.

(6)  Liability for Delays
Claims for damages due to delayed delivery are excluded unless the delay was caused by intent or gross negligence on our part. In all other cases, we are only liable for proven direct damages.

(7) No Exclusion of Statutory Rights
This clause does not limit your statutory rights as a consumer. In particular, your right of withdrawal and the right to cancel the order in case of delayed delivery remain unaffected.

§5 Retention of Title

We retain ownership of the goods until the purchase price has been paid in full.

§6 Customer’s Right of Withdrawal as a Consumer

Consumers are entitled to a right of withdrawal according to the following provisions, where a consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without providing any reason. The withdrawal period is fourteen days from the day you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g., a letter sent by post, fax, or email) about your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not required.

Consequences of Withdrawal

If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day we received notification of your withdrawal from this contract. For this repayment, we will use the same payment method you used for the original transaction unless expressly agreed otherwise; in no case will you be charged any fees for this repayment.

We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.

You must return the goods without undue delay and in any event no later than fourteen days from the day you informed us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.
